# Your Mortgage When Your Partner Dies

Your partner has died, and in the middle of all the grief you also have to deal with practical matters, such as the mortgage. That may feel too soon and too heavy, and it is. Even so, it helps to know where you stand at a quiet moment, so that financial surprises are not added to everything else. On this page you will read what happens to your mortgage when your partner dies, and which steps you can take.

## Did you have term life insurance? That makes a big difference

Term life insurance (in Dutch: overlijdensrisicoverzekering, or ORV) pays out a sum when your partner dies, often exactly enough to repay all or part of the mortgage debt. Did your partner have a policy like this linked to your mortgage? Then the payout is usually used to reduce the loan, which lowers your monthly payments considerably or removes them altogether. In many cases you can simply stay in your home, even though part of the household income has fallen away.

Was there no policy, or did it not cover the full mortgage amount? Then the entire debt remains in place, while you probably have only one income left. That is exactly the moment when housing costs that used to be perfectly manageable suddenly start to pinch. Not sure whether a policy was in place? Look it up in the mortgage deed or ask your bank or advisor, so you quickly know where you stand.

## The lender takes a fresh look at your income

Was the mortgage in both names and based on two incomes? Then after the death, the lender may reassess whether the mortgage is still responsible on your income alone. That does not automatically mean you have to change the mortgage, or that the bank will demand a new one. The outcome depends on the mortgage terms, your income, the value of the home, the remaining debt and any insurance payouts.

## Staying in your home, or selling after all?

Whether that is possible depends on your income, the remaining mortgage debt and whether there is an insurance payout that reduces the loan. Sometimes adjusting the mortgage is enough. In other cases, selling turns out to be the healthier choice in the long run, for example when the housing costs are structurally too high for one income. ## NHG: protection if the home has to be sold at a loss

Do you have a mortgage with the Dutch National Mortgage Guarantee (NHG)? Then NHG can, under certain conditions, help if the home has to be sold at a loss after your partner's death. NHG treats death, in certain situations, as grounds for regarding the sale as made "in good faith". In addition, the criterion of full cooperation must be met. Think of meeting your obligations as far as possible, maintaining the home properly and trying to sell it for the highest possible price. So having the residual debt waived is not automatic.

Fortunately, we have not had to go through this with a client yet. But we do always advise taking a proper look at term life insurance. Partly to make sure people do not run into financial trouble if someone actually dies. And partly because it gives many people lasting peace of mind to know that, should the worst happen, things are financially well arranged for the other person.
